RESOLUTIONRelating to: SECTION 274J OF ATOMIC ENERGY
WHEREAS: Public Law 96-295 was approved June 30, 1980; and
WHEREAS: PL 96-295 added Section 274j(2) to the Atomic Energy Act of 1954, as amended; and
WHEREAS: Section 274j(2) provides for temporary suspension of regulatory agreements which have been entered into between the U.S. Nuclear Regulatory Commission (NRC) and the affected member States of this Conference of Radiation Control Program Directors, Inc. (CRCPD); and
WHEREAS: No specific criteria have been provided by the U.S. Congress or the NRC for invoking the emergency suspension provisions; and
WHEREAS: The affected member States of this CRCPD desire to know under what criteria the NRC will respond to a request from a State for temporarily suspending an agreement; and
WHEREAS: The affected member States of this CRCPD desire to know under what criteria the NRC may initiate on its own a temporary suspension of an agreement; and
WHEREAS: Interested parties should be informed of the criteria which might result in a temporary suspension of an agreement.
NOW THEREFORE, BE IT RESOLVED: That the CRCPD, representing the radiation control programs of all fifty states including twenty-six which have currently effective agreements with the NRC, urges the U.S. NRC to develop criteria, with appropriate consultation with the States, which state the conditions under which the provisions of Section 274j(2) of the Atomic Energy Act of 1954, as amended, would be invoked.
